Important Update for Building Owners and Managers

From 5 May 2025, Auckland Council will begin issuing $1000 infringement notices in addition to the existing Notice to Fix if a Building Warrant of Fitness (BWoF) is overdue by over one month.

This is a significant step up in enforcement under Section 108(5)(aa) of the Building Act 2004. This means compliance is more important than ever. The grace period still applies, but the consequences for missing deadlines just got real.

Also noteworthy: The Council will no longer email confirmations when a BWoF is accepted. If you don’t hear back, assume compliance unless contacted otherwise.
